Introduction and Legal Terms
By accessing our website, any associated platform, or any services provided by Link Studio design studio (collectively referred to as the "Platform"), you confirm that you have read, understood, and agree to abide by these Terms of Use ("Terms"). All rights to the Platform are expressly reserved by Link Studio. These Terms govern the conditions applicable to your use of the Platform and Services, and you are advised to read them carefully before using the Platform. Your continued access to or use of the Platform will be deemed as acceptance of these Terms. Certain provisions of these Terms may limit Link Studio's risk or liability, constitute your acceptance of risk or liability, impose an obligation on you to indemnify Link Studio for losses, or serve as confirmation of certain facts. The terms "user", "you", and "your" refer to any person accessing or using the Platform, and the terms "we", "us", or "our" refer to Link Studio.
Our Services
Link Studio provides professional digital design services, including, but not limited to, branding, website design and development (including platforms like Framer), presentation design, and 3D & motion design, collectively referred to as "Services". The scope, timing, and procedure for providing such Services may be further defined in separate agreements, proposals, or communications between you and Link Studio.
Communication
By interacting with the Platform or submitting an inquiry, you agree that Link Studio will contact you via electronic means, including, but not limited to, email and messengers such as WhatsApp, Telegram, or similar services. Such communication may be used to respond to inquiries, provide Services, request information, offer services, or address any feedback, questions, or concerns. You confirm that such communication is part of the normal operation of the Services.
Liability and Warranties
By using the Platform and/or Services, you warrant that you have read and agree to these Terms and will use the Platform in accordance with them. You also warrant that all information provided by you is true, accurate, and complete in all respects and that you have not made any misrepresentations. You confirm that you are at least 18 (eighteen) years old or have obtained the necessary consent from a parent or legal guardian who accepts responsibility for your use of the Platform. You also warrant that you legally possess all rights to any materials, content, or information provided to Link Studio, and that such transmission does not violate the rights of third parties. You agree to indemnify Link Studio for any losses resulting from the use of such materials. You agree not to upload, transmit, or otherwise make available content that is unlawful, threatening, defamatory, abusive, discriminatory, or invasive of privacy. You also agree not to interfere or attempt to interfere with the proper functioning of the Platform by any means, including, but not limited to, using malicious code, unauthorized access attempts, or disrupting systems. You must not use the Platform for any purpose that is unlawful or prohibited by these Terms, nor violate any intellectual property rights or facilitate such actions by third parties. Any violation of this section will be considered a material breach of these Terms and may result in immediate suspension or termination of your access to the Platform, as well as potential legal proceedings.
Platform Access and Technical Requirements
Access to the Platform is through internet-enabled devices, and you are responsible for acquiring and maintaining the necessary hardware, software, and network connection required for access. Link Studio does not guarantee uninterrupted operation of the Platform, the absence of delays and errors, or its compatibility with all devices or systems. Access to the Platform may be suspended or restricted at any time for maintenance, updates, or other operational reasons without prior notice.
Communications, Data Transmission, and External Links
Communications exchanged with Link Studio, including emails and messages sent via communication platforms, are considered received by Link Studio only after we confirm receipt of such messages or respond to them. Messages sent by Link Studio are considered received by you once they reach your specified communication channel and become available for receipt and processing by you. You acknowledge that data transmission over the Internet is not completely secure and may be subject to interception, loss, or alteration. Accordingly, Link Studio is not responsible for the integrity, confidentiality, or security of any electronic communications transmitted between the parties, or for any loss or damage arising therefrom. The Platform may contain links to third-party websites or services. Link Studio does not own, control, or endorse such third-party resources and is not responsible for their content, availability, or any consequences arising from their use. Access to such third-party platforms is solely at your own risk.
Intellectual Property
All content, materials, and elements of the Platform, including, but not limited to, text, graphics, designs, layouts, user interface elements, software code, branding, and any other intellectual property, belong to Link Studio or are licensed to it and are protected under applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform solely for the purposes provided for in these Terms. You do not have the right to copy, reproduce, modify, distribute, publish, or otherwise use any part of the Platform without the prior written consent of Link Studio. All intellectual property provided by you remains your property; however, by providing such materials, you grant Link Studio a non-exclusive license to use them to the extent necessary to provide the Services. You agree to indemnify Link Studio for any losses resulting from the use of such work. Link Studio reserves the right at any time and without prior notice to modify, update, or delete any content on the Platform.
Disclaimer and Limitation of Liability
The Platform and Services are provided on an "as is" and "as available" basis, and Link Studio makes no representations or warranties, express or implied, regarding the accuracy, reliability, availability, or suitability of the Platform or Services. Link Studio does not guarantee uninterrupted access, the absence of errors, or the absence of malicious components on the Platform. To the maximum extent permitted by law, Link Studio shall not be liable for any direct, indirect, incidental, consequential, or special damages, including, but not limited to, loss of profits, loss of data, or business interruption arising out of or in connection with the use of the Platform or Services. Indemnification
You agree to indemnify, defend, and hold harmless Link Studio, its employees, partners, and affiliates from any claims, liabilities, damages, losses, or expenses, including legal fees, arising out of or in connection with your use of the Platform, your violation of these Terms, or your violation of any third-party rights. This obligation shall survive the termination of these Terms.
Dispute Resolution
In the event of any disputes related to the use of the Platform or Services, the parties agree to first attempt to resolve such dispute through good faith negotiations. If the dispute cannot be resolved through negotiations, the parties may refer to mediation involving an independent third party. If mediation fails, the dispute may be referred to arbitration or a competent court. The parties agree not to publicly disclose any disputes prior to attempting to resolve them using the mechanisms described above.
Termination of Use
Link Studio reserves the right, in its sole discretion, to suspend or terminate your access to the Platform or Services in the event of a violation of these Terms or for any other legitimate reason, with reasonable notice where applicable. You may terminate your use of the Platform at any time; however, such termination shall not affect any rights or obligations arising prior to termination.
Notices
Any notices required under these Terms may be sent by email or other communication channels provided by you. Notices are considered received upon delivery to the appropriate communication channel and provision of access to them.
General Provisions
These Terms may be updated or amended from time to time, and such amendments shall take effect upon publication on the Platform. Continued use of the Platform constitutes acceptance of the updated Terms. Nothing in these Terms shall be construed as creating any partnership, joint venture, or employment relationship between the parties. Neither party shall be liable for failure to perform obligations due to events beyond its reasonable control, including, but not limited to, natural disasters, utility failures, or government actions. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
